We guarantee that your Tivic ClearUP device will arrive in perfect condition. If your device isn’t working as expected, our team is here to help you troubleshoot the issue and, if necessary, replace the device under certain conditions.

Important Note – Before Returning Your Device

While customers have experienced truly amazing results, sinus pain and congestion responses vary from person to person. We encourage you to initially use the ClearUP device 2-4 times a day for 2-4 weeks to achieve optimal results. If after this period you are not satisfied with the level of sinus relief, or for any reason, you can return the device for a full refund within 90 days of the original purchase date, under Tivic’s Shipping & Returns Policy.

If you are purchasing ClearUP as a gift or have received ClearUP as a gift, please ensure that you keep the order information or proof of purchase. This will be important if you need to contact Tivic Customer Support for any return/replacement.

LIMITED WARRANTY COVERAGE

EXCLUSIVE REMEDY

Your ClearUP purchase automatically comes with a standard 1-year limited manufacturer’s warranty. Warranty coverage begins from the date of your ClearUP purchase for 365 days. If your Tivic ClearUP device fails to meet the warranty conditions during the applicable warranty period, Tivic Health, at its sole discretion, may choose to repair, replace, or provide a credit to the original end user. In the case of a replacement, Tivic reserves the right to replace the device with either a new or refurbished unit. Please note, the warranty period for a replacement device will not extend beyond the original warranty period of the device it replaces.

WARRANTY SERVICE

To obtain warranty service, please contact Tivic Customer Service for instructions by emailing customerservice@tivichealth.com or leaving a message at 1-888-276-6888. Please include your Order Number and Proof of Purchase from Tivic or an authorized seller. Hours of operation are Monday-Friday, 7AM – 4PM PST. Live representatives may not always be available, but we will respond within 24-48 hours.

If a return is necessary for warranty replacement, an authorized Return Material Authorization (RMA) number is required. Items returned without an RMA number on the approved label will not be accepted. The item must be mailed by the customer within 14 days of receiving the prepaid return label from Tivic. If you haven’t received the label, please reach out to Customer Service to verify.

Failure to return the item within this timeframe may result in the rejection of the warranty replacement at the customer’s expense. The customer may be responsible for shipping the item to a destination specified by Tivic or forfeiting their warranty eligibility.

IMPORTANT DETAILS:

  • Proof of ClearUP purchase from an authorized seller is required. Please contact Tivic Health Customer Service if you are not sure if the seller you are purchasing from is authorized. 3rd party/private sellers are never authorized on behalf of Tivic.
  • Devices must be in their original shipped condition. Any replacement, tampering, or dismantling of the device or its components will invalidate the warranty.
  • The ClearUP device, its charger, and any other purchased accessories must be returned to receive a full replacement of those items.
  • Warranty replacements will be processed only after we have received and inspected the device and its components. While typically we handle these replacements quickly for our customers, it could take up to 30 days from the time it reaches our warehouse. We appreciate your patience and understanding.
  • If the device has been damaged due to mistreatment, exposure to water, or tampering, the warranty will be voided.
  • Returns that do not meet these conditions may be rejected, and any related costs will be the customer’s responsibility.
  • Warranty coverage does not apply on accessory purchases without a ClearUP device.
  • Warranty coverage does not apply on purchases of the extended warranty.
  • Additional terms and conditions may apply to promotional sales.

 

EXTENDED WARRANTY COVERAGE

Your Tivic ClearUP purchase comes with a 1-year warranty. For added peace of mind, you can purchase an extended warranty that provides an additional year of coverage, giving you a total of 2 years from the date of your ClearUP purchase at Tivichealth.com. To extend your coverage, simply purchase by choosing the cart option to add the extended warranty before checkout; Or contact Tivic Customer Service for instructions to purchase under certain conditions. The purchase of an extended warranty is non-refundable, even if the ClearUP device is returned. No refunds will be issued under any circumstances for the purchase of extended warranty coverage.

  • The extended warranty will cover your device for 2 years from the original date of the ClearUP purchase; Not the date of the extended warranty purchase.
  • Only one warranty is valid per unit. To ensure each ClearUP device is fully protected, extended warranties must be purchased separately for each device included in your order, unless otherwise specified by Tivic.
  • If an extended warranty is selected for a ClearUP purchase in your cart, any additional ClearUP added to the cart within that purchase will automatically add the extended warranty at cost, to match the number of units being sold. If you prefer to only purchase coverage for 1 unit, you may do so by purchasing your orders separately.
  • Devices purchased from unauthorized sources or resold by the original buyer are NOT eligible for any return, refund, or warranty from Tivic. 
  • The extended warranty service is only available and valid for orders placed directly through Tivichealth.com or an authorized seller approved by Tivic.
  • If you bought your ClearUP from an authorized seller and wish to add an extended warranty, please reach out to us at customerservice@tivichealth.com.
  • Warranty coverage does not apply to accessories, it is solely applicable to the ClearUP unit (includes the original device and charger).
  • The purchase price of the extended warranty is non-refundable, even if the ClearUP device is returned. No refunds will be issued under any circumstances for the purchase of extended warranty coverage.
  • Additional terms and conditions may apply to promotional sales.

For Our Amazon Customers:

  • Tivic’s standard refund & warranty policies are honored for purchases made on Tivic’s Amazon FBA (Fulfilled by Amazon) or Fulfilled by Tivic Health pages. For assistance, contact customerservice@tivichealth.com directly.
  • Tivic ClearUP purchases fulfilled by any vendor other than Tivic Health directly are not eligible for a refund outside of Amazon’s return policies, but they are covered under the standard Tivic 1-year warranty with purchase under an approved seller (“Simply Medical”). Extended warranties may be purchased separately through Tivic directly, if available. Please contact us with your Amazon order number/proof of purchase for support.

 

OBLIGATIONS AND WARRANTY LIMITS

EXCEPT FOR THE LIMITED WARRANTY SET FORTH ABOVE, TIVIC HEALTH MAKES NO OTHER WARRANTIES AND DISCLAIMS ALL OTHER REPRESENTATIONS, GUARANTIES, CONDITIONS AND WARRANTIES CONCERNING THE DEVICE, WHETHER DIRECT OR INDIRECT, EXPRESS OR IMPLIED, OR ARISING UNDER ANY STATUTE, ORDINANCE, COMMERCIAL USAGE OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OR REPRESENTATION AS TO FITNESS FOR PURPOSE, DURABILITY, DESIGN, MERCHANTABILITY, OR CONDITION OF THE DEVICE (OR ANY PART THEREOF), OR RELATING TO THE INFRINGEMENT OF ANY PATENT, COPYRIGHT, OR OTHER PROPRIETARY RIGHT USED OR INCLUDED THEREIN.

ALTHOUGH THE DEVICE IS APPROVED FOR SALE BY THE FDA FOR THE TEMPORARY RELIEF OF SINUS PAIN ASSOCIATED WITH ALLERGIC RHINITIS, THE RESPONSE AND EFFICACY WILL VARY BASED ON THE USER’S PHYSIOLOGY AND OTHER VARIABLE FACTORS AND TIVIC HEALTH MAKES NO WARRANTY THAT ANY SPECIFIC RESULTS WILL BE ACHIEVED THROUGH THE USE OF THE DEVICE OR THAT ANY RELIEF FROM SINUS PAIN WILL BE ACHIEVED AND ALL SUCH WARRANTIES ARE HEREBY EXPRESSLY DISCLAIMED. IF ANY IMPLIED WARRANTIES APPLY AS A MATTER OF LAW, THEY ARE LIMITED IN DURATION TO THE LENGTH OF THIS LIMITED WARRANTY. SOME STATES MAY NOT RECOGNIZE A DISCLAIMER OR LIMITATION OF WARRANTIES AND/OR LIMITATION OF LIABILITY SO THE ABOVE DISCLAIMER AND EXCLUSIONS MAY NOT APPLY. IN NO EVENT SHALL TIVIC HEALTH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION LOSS OF PROFITS OR LOSS OF USE), WHETHER OR NOT TIVIC HEALTH SHALL BE OR SHOULD BE AWARE OF THE POSSIBILITY OF SUCH POTENTIAL LOSS OR DAMAGE.

REPRESENTATIONS AND WARRANTIES MADE BY ANY PERSON, INCLUDING BUT NOT LIMITED TO DISTRIBUTORS, REPRESENTATIVES, SALESPERSONS, OR AGENTS OF TIVIC HEALTH, WHICH ARE INCONSISTENT OR IN CONFLICT WITH OR IN ADDITION TO THE TERMS OF THIS LIMITED WARRANTY, SHALL NOT BE BINDING UPON TIVIC HEALTH UNDER ANY CIRCUMSTANCE.

THIS LIMITED WARRANTY IS THE COMPLETE AND EXCLUSIVE STATEMENT OF WARRANTY WHICH TIVIC HEALTH AGREES TO PROVIDE WITH RESPECT TO THE DEVICE AND IT SHALL SUPERSEDE ALL PRIOR AND CONTEMPORANEOUS ORAL OR WRITTEN AGREEMENTS, UNDERSTANDINGS, PROPOSALS, AND COMMUNICATIONS PERTAINING TO THE SUBJECT MATTER HEREOF.
